Terms of Service

1. Who we are
Budhix and Prachara are operated by Jayanth Joseph (sole proprietor), trading as Zlotworks, India ("Zlotworks", "we", "us", or "our"). We provide two platforms: Budhix, a business management platform for local service businesses, and Prachara, a customer marketing service for local retail businesses.
2. Description of service
Budhix is a booking and business management platform for local service businesses. Budhix is not a party to the underlying service contract — the actual service (a consultation, haircut, class, etc.) is provided by the business you book with.
Prachara is a customer marketing service that lets local retail businesses message their own existing customers, subject to Meta's messaging policies.
3. Eligibility
Business owners and staff using an administration dashboard must be at least 18 years old and authorised by their business. A minor may be the subject of an appointment only when the booking is made or supervised by a parent, guardian, or other authorised adult.
4. Customer responsibilities (end customers)
- Provide accurate name and contact details when booking (Budhix).
- Arrive at the scheduled time — repeated no-shows may result in a business declining future bookings.
- Do not use either service to send spam, abusive messages, or to impersonate others.
5. Business responsibilities
If you are a business using Budhix or Prachara, you must have a lawful basis and appropriate consent before messaging your customers, are responsible for the accuracy of data you upload, must comply with WhatsApp's Business Platform and commerce policies, and must keep your WhatsApp Business account in good standing. You are responsible for your own business licences and regulatory compliance.
6. Messaging consent
By messaging a Budhix-powered number, you request and consent to booking-related replies from that number. Businesses using Prachara must have a lawful basis and obtain any consent required before messaging a customer. Recipients can opt out of marketing at any time by replying STOP or contacting us at hello@zlotworks.com.
7. Intellectual property
All software, design, trademarks, and content across Budhix and Prachara are owned by Zlotworks or licensed to us. You may not copy, reproduce, or distribute any part of either platform without our written permission.
8. Limitation of liability
To the maximum extent permitted by applicable law: we are not liable for the quality or outcome of any service provided by a business booked through Budhix, nor for losses arising from WhatsApp/Meta platform downtime. Our total liability for any claim is limited to INR 1,000, and we are not liable for indirect or consequential damages.
9. Indemnity
You agree to indemnify and hold harmless Zlotworks from claims, damages, or costs (including legal fees) arising from your violation of these Terms or misuse of either service.
10. Service availability
We aim for high availability but do not guarantee uninterrupted service, and are not liable for inconvenience caused by downtime or maintenance.
11. Modifications to these terms
We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance of the updated Terms.
12. Termination
We may suspend or terminate your access if you violate these Terms or misuse either service. You may stop using either service at any time.
13. Governing law and disputes
These Terms are governed by the laws of India, and disputes are subject to the jurisdiction of the courts in India.
